It seems like he is leaning toward siding with the Brady and the NFLPA, but he started last week’s meeting by saying that nobody should read into his line of questioning. Despite the union’s seemingly insurmountable lead, the NFL holds the ultimate secret weapon, a 70-point touchdown that can render the first 58 minutes of the game completely meaningless.
Neither Brady nor NFL Commissioner Roger Goodell was in court Wednesday.
It’s basically the NFL’s only legitimate argument in this lawsuit. Through collective bargaining, Goodell was given full power to discipline players.
We’ll see if Berman agrees. It also is a telling list: The 18 cases date to 1970, and only two arbitrations have been overturned since the turn of the century (in 2003 and 2007). ESPN’s Adam Schefter describes how this could result in Brady being banned from Gillette Stadium for the Patriots first game against the Pittsburgh Steelers. As satisfying as it is, though, Newsweek’s Brian Holland has a far more sinister theory: DeflateGate has never been about facts, fairness, competition, or “integrity of the game”.
Berman flat-out rejected the comparison Goodell made between deflating footballs and steroid use.
When things have gone in the league’s favor, Brady has fought it. Now that the tide may be turning. “For the 60 minutes that Nash stood at a lectern on the 17th floor of the courthouse before approximately 60 spectators, Berman peppered him with questions”.
“‘I have a little trouble with that”, Berman responded.
“You have to allow someone to make their case by calling witnesses”, he said. I think he’s trying to do what’s right here.
Sitting out for four games would cost him $470,000 a game, or a total of $1.9 million based on his 2015 salary of $8 million.
