Samsung hopes to take patent war with Apple to the Supreme Court

After the U.S. Federal Circuit Court of Appeals rejected Samsung last week, refusing Samsung’s request for a new trial.



A court document picked up by Mac Rumors states, “The questions present issues of enormous importance to patent litigation and scope of innovation, especially in high-technology industries”. (NASDAQ:AAPL) damages amounting to $548 million for reportedly infringing on the latter’s intellectual property.

The move had been widely predicted after a federal court threw out its demands to have a new trial and $400 million in damages waived.

The electronics giant said in a court filing on Wednesday, Aug 19, that it plans to ask the country’s highest court later this year to take up the case, in which Samsung is arguing a Silicon Valley jury erred in a 2012 verdict that left it with a hefty legal bill and massive fines.

If that was decided, Samsung would be forced to pay Apple.

In the event that it feels like the fight in court in the middle of Apple and Samsung has been continuing for quite a long time, well, that is on account of it has.

Should it decide to look at the case, the Supreme Court will set the stage for one of the most high-profile legal showdowns involving two tech firms.

Of course the USPTO invalidating a patent isn’t the last word and we posted a report back in 2012 with statistics from the U.S. Patent Office showing that in the majority of these cases the ruling is eventually overturned with modest modifications. The fact that the Supreme Court only accepts about 75 petitions annually out of a possible 10,000 applications further accelerates doubts of the company getting its wish.
