The report reportedly finds that Caitlyn violated Penal Code section 192(c), which corresponds to misdemeanour vehicular manslaughter law.
Investigators found Jenner was driving “unsafe for the prevailing road conditions” because her SUV rear-ended a Lexus, pushing it into oncoming traffic, Los Angeles County Sheriff’s Department spokeswoman Nicole Nishida said.
The 65-year-old Olympic gold medallist was accused of causing a fatal four-car collision on the Pacific Coast Highway in Malibu after striking another vehicle in transit last February.
She was unable to stop which resulted in Jenner hitting two other vehicles, Howe’s Lexus and a Toyota Prius.
Jessica Steindorff, another woman involved in the crash, could also be facing charges over the tragic incident.
“We have completed the investigation and will present the case to the DA’s Office next week”, Lieutenant Patrick Mathers of the Los Angeles County Sheriff’s Malibu/Lost Hills Station said Thursday.
The charge is a misdemeanor, so the most Jenner could get is one year in jail.
A similar CNN report noted that Jenner’s case will be endorsed to the district attorney. Jenner later released a statement expressing sympathy with Howe’s family, calling it “a devastating tragedy”.
However, the report said, citing sources, that there was a doubt whether Jenner will be prosecuted at all because her conduct was not too different from that of inattentive drivers. “I will cooperate in any way possible” she said.
Howe’s stepchildren have already filed a lawsuit against Jenner in the crash, NBC News reported.
Jenner’s transition has played out in public over the past several months.
